WC Travel and Hospitality is operated by Miles Harding as a sole proprietorship based in Ontario, Canada.
1. Services
We provide brand strategy, website hosting (via GoHighLevel), CRM setup and training, and digital advertising services (primarily Meta Ads, with potential Google Ads support). We also assist with domain management through GoDaddy when required.
We do not directly manage client leads. We provide tools, setup, and training, but clients remain responsible for handling their own customer communications and data.
2. User Representations
By using our services, you represent and warrant that:
- You are at least 18 years of age.
- You have the legal capacity and authority to agree to these Terms.
- You will comply with all applicable laws, including Canadian Anti-Spam Legislation (CASL).
- You will not use our services for unlawful, harmful, or unauthorized purposes.
- You will provide accurate information and keep it up to date.
3. Prohibited Activities
You may not use our website or services to:
- Send spam or unsolicited communications in violation of CASL.
- Upload or transmit viruses, malware, or harmful code.
- Misuse CRM systems or advertising platforms.
- Infringe on intellectual property rights.
- Harass, intimidate, or threaten our staff, partners, or clients.
- Circumvent security measures or misuse access to our platforms.
Any violation may result in suspension or termination of services.
4. Client Responsibilities
Clients agree to:
- Provide accurate and complete information necessary for services.
- Manage their own CRM data and customer leads responsibly.
- Comply with third-party terms (GoHighLevel, GoDaddy, Meta Ads, Google Ads).
- Meet payment obligations as agreed.
- Ensure lawful use of all deliverables, campaigns, and platforms.
5. Intellectual Property
WC Travel and Hospitality retains ownership of frameworks, methodologies, and materials developed during service delivery. Final deliverables (e.g., website designs, ad creative, strategy documents) become the client’s property upon full payment, unless otherwise agreed in writing.
Clients grant WC Travel and Hospitality the right to reference completed projects in our portfolio or marketing materials.
6. Third-Party Tools and Services
We rely on third-party platforms including GoHighLevel, GoDaddy, Meta Ads, and Google Ads. These services are governed by their own terms and privacy policies, which clients are responsible for reviewing. We are not liable for outages, policy changes, or data practices of these third parties.
7. Termination and Suspension
We may suspend or terminate services if:
- Payments are not made on time.
- A client breaches these Terms or applicable laws.
- There is misuse of CRM, hosting, or advertising tools.
Upon termination, outstanding fees remain payable and intellectual property ownership will follow Section 5.
8. Limitation of Liability
Our services are provided on an 'AS IS' and 'AS AVAILABLE' basis. To the maximum extent permitted by law, WC Travel and Hospitality is not liable for indirect, incidental, or consequential damages, including lost profits, revenue, or data.
Our total liability for any claim shall not exceed the total fees paid by the client in the three (3) months preceding the claim.
9. Disclaimer of Guarantees
We do not guarantee specific business outcomes, leads, or revenues. Marketing results vary depending on industry, market conditions, and client execution.
10. Indemnification
Clients agree to indemnify and hold harmless WC Travel and Hospitality and its representatives against any claims, damages, or liabilities arising from client misuse of services, breach of laws (including CASL), or violation of third-party terms.
11. Electronic Communications and Signatures
By using our website or services, you consent to receive electronic communications. You agree that contracts, agreements, invoices, and records provided electronically satisfy legal requirements for written agreements. Electronic approvals, payments, or signatures are legally binding.
12. Governing Law
These Terms are governed by the laws of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.
13. Changes to Terms
We may update these Terms from time to time. Updates will take effect upon posting with a revised 'Last Updated' date. Continued use of our services constitutes acceptance of the revised Terms.
